INFORMATION REGARDING THE PERSONAL DATA PROTECTION LAW

Karakuş İthalat İhracat Uluslararası Taşımacılık Sanayi ve Ticaret A.Ş. takes the highest level of security measures to ensure that your personal data is collected, stored, and shared in accordance with the law and to protect your privacy. Our aim is to provide you with transparent information in accordance with Article 10 of Law No. 6698 on the Protection of Personal Data, including how your personal data is collected, its purposes of processing, recipients, legal grounds, and your rights.

a) Data Controller
Pursuant to the Personal Data Protection Law No. 6698 (“Law No. 6698”), your personal data will be collected and processed by Karakuş İthalat İhracat Uluslararası Taşımacılık Sanayi ve Ticaret A.Ş. (“KARAKUŞ”) within the scope explained below.

b) Purposes of Processing Personal Data
KARAKUŞ may collect personal data from customers, employees, potential customers, job candidates, business partners, website users, and suppliers, including identity information, contact details, customer information, transaction information, transaction security data, legal compliance information, and marketing/sales information.

Collected personal data may be used for purposes such as:

• -Delivering KARAKUŞ products and services, fulfilling our obligations to you, maintaining records and documentation, complying with domestic and international legal requirements, reporting, informing, tax, and other obligations.

• -Conducting marketing and sales activities, providing personalized advertisements, campaigns, advantages, and other benefits.

• -Communication for IT needs, system structure, and support services, transferring necessary information regarding these services and products.

• -Ensuring compliance with quality management system requirements when needed.

• -Performing traffic measurement, statistical analysis, segmentation/profiling, and CRM activities for marketing and sales purposes.

• -Measuring and enhancing customer satisfaction, managing complaints, obtaining opinions and suggestions on new services/products, addressing issues/errors, and providing information related to products, services, complaints, and requests.

• -Comparative product/service offerings, modeling, developing existing or new products/services, and using personal data in accordance with KARAKUŞ’s main contract and applicable laws.

• -Complying with information storage, reporting, and notification obligations required by official authorities, fulfilling contract requirements, and adhering to legal obligations related to the provision of these services.

• -Managing KARAKUŞ commercial and business strategies, including logistics, finance, communication, market research, corporate social responsibility, procurement operations (requests, offers, evaluations, orders, budgeting, contracts), internal system and application management, and legal operations.

• -Reviewing, evaluating, and responding to requests from official authorities or individuals.

• -Fulfilling the requested services within the framework of Articles 5 and 6 of Law No. 6698 and personal data processing conditions.

c) Recipients of Processed Personal Data
Your collected personal data may be shared solely to achieve the purposes mentioned above, with:

• KARAKUŞ group companies, business partners, shareholders, subsidiaries, and other persons or entities permitted under Turkish Commercial Code, Customs Law, Turkish Code of Obligations, and other applicable laws.

• Legally authorized public institutions, administrative bodies, and legal authorities.

• Third parties, service providers, partner institutions, contracted companies, and cargo firms involved in sending communications, documents, or shipments, within the framework of Articles 8 and 9 of Law No. 6698.

d) Method and Legal Basis for Collecting Personal Data
Your personal data is collected verbally, in writing, or electronically via our website, social media accounts, or other potential channels established in the future, limited to the purposes specified above. Legal grounds include contract execution, explicit legal provisions, public disclosure by the data subject, necessity for establishing, using, or protecting a right, legitimate interests of KARAKUŞ, and fulfilling legal obligations, provided that it does not harm your fundamental rights and freedoms.

e) Rights of Personal Data Owners under Article 11 of Law No. 6698
You have the following rights:

• -To learn whether your personal data is processed,

• -To request information if your personal data has been processed,

• -To learn the purpose of processing and whether it is used accordingly,

• -To know third parties to whom personal data is transferred domestically or abroad,

• -To request correction of incomplete or inaccurate data and to notify third parties,

• -To request deletion or destruction of personal data when legal grounds no longer exist and notify third parties,

• -To object to results produced by automatic processing of data against yourself,

• -To claim compensation for damages caused by unlawful processing of personal data.

-To exercise your rights, you can submit your request in Turkish, signed by hand, to the data controller’s address; electronically signed to karakusithalat@hs03.kep.tr; or via info@karakus.com using your previously registered email, or other methods listed in the Communiqué on Procedures and Principles for Application to Data Controller.

Your request must include:
a) Name and surname, and signature if written,
b) Turkish ID number for citizens, or nationality, passport, or ID number if foreign,
c) Residential or business address for notification purposes,
d) Email, phone, and fax (if applicable),
e) Subject of the request and related documents, if any.

Requests must include complete and accurate information and documents. Failure to do so may hinder the proper investigation and handling of your request. KARAKUŞ reserves its legal rights.
